Privileged information receives heightened protection under the law, but that protection does not apply automatically once documents are pasted into third-party AI tools: at least one federal court has held AI chats are not privileged, and voluntary disclosure to third parties can waive both attorney-client privilege and work product protection. The work product doctrine, established in Hickman v. Taylor, protects attorney mental impressions and legal theories from discovery, and confidential attorney-client communications are similarly shielded, yet both protections can be lost through voluntary disclosure, so the prudent approach is to keep identifiable client content out of any external system.
